Terms and Conditions of Accommodation宿泊約款

Article 1
(Scope of Application)

1.Contracts for Accommodation and related agreements between this Hotel and the Guest shall be subject to the following
Terms and Conditions.
Anything not included within the following list shall be governed by laws and regulations and/or generally accepted practices.
2. In case the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the preceding Paragraph, the special contract shall take precedence over the provisions of these Terms and Conditions.


Article 2
(Application for Accommodation Contracts)

1.A Guest who intends to apply for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
(1) Name of the Guest(s)
(2) Date of accommodation and estimated time of arrival
(3) Accommodation Charges (based, in principle, on the Basic Accommodation Charges listed in the Attached Table No.1); and
(4) Other particulars deemed necessary by the Hotel.
2. In the case when the Guest requests, during the Guest's stay,extension of the accommodation beyond the date in subparagraph (2) of the preceding paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.


Article 3
(Conclusion of Accommodation Contract, etc.)

1.A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article. However, the same shall not apply when it has been proved that the Hotel has not accepted the application.
2 Even in the case when an application for accommodation is made and accepted based on the incorrect Accommodation Charges offered by the Hotel through Internet websites or by phone, if such Accommodation Charges are significantly lower than those for the days around the date of
accommodation, such acceptance shall be deemed to have been made by mistake under the Civil Code unless the reason why such Accommodation Charges are significantly low is given (such as a “limited” or “special” offer), and the Hotel shall treat such Accommodation Contract.
3 When a Contract for Accommodation has been concluded in accordance with the provision of the preceding Paragraph, the Guest is requested to pay an accommodation deposit fixed by the Hotel within the limits of Basic Accommodation Charges covering the Guest's entire period of Stay by the date specified by the Hotel.
4 When the Guest has failed to pay the deposit by the date as stipulated in Paragraph 3 of Article 3, the Hotel shall treat the Accommodation
Contract as invalid.


Article 4
(Special Contracts Requiring No Accommodation Deposit)

1. Notwithstanding the provisions of Paragraph 3 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation
deposit after the Contract has be en concluded as stipulated in the same Paragraph.
2. In the case when the Hotel has not requested the payment of the deposit as stipulated in Paragraph 3 of the preceding Article and/or has not specified the date of payment of the deposit at the time an application for the Accommodation Contract has been accepted, it shall be treated as that the Hotel has accepted a special contract prescribed in the preceding Paragraph


Article 5
(Refusal of Accommodation Contracts)

The Hotel may not accept the conclusion of an Accommodation Contract under any of the following causes
(1) When an application for accommodation does not conform with the provisions of these Terms and Conditions
(2) When the Hotel is fully booked and no room is available
(3) When the Guest seeking accommodation is deemed likely to conduct himself/herself in a manner that will contravene laws, public order or good morals in regard to his/her accommodation
(4) When those wishing to stay are deemed to fall under any of the following (a) through (c)
(a) An organized crime group as defined by Article 2, Item 2 of the Act to Prevent Unjust Acts by Organized Crime Group Members (Act No.77 of 1991) (hereinafter, “Criminal Gang”), members of an organized criminal group as defined by Article 2, Item 6 of said act (hereinafter,
“Gang Members”), associate members or affiliates of Criminal Gangs or other such antisocial groups
(b) When the business activities of a corporation or other organizations are controlled by a Criminal Gang or Gang Members
(c) A corporation whose executives include anyone determined to be a Gang Member
(5) When those wishing to stay have caused considerable trouble to other guests through their words or actions
(6) When the Guest seeking accommodation is clearly detected to be carrying an infectious disease
(7) When the Hotel is requested to assume an unreasonable burden in regard to the Guest's accommodation
(8) When the Hotel is unable to provide accommodation due to natural calamities, dysfunction of the facilities and/or other unavoidable causes
(9) When conforming to the cases stipulated by Prefectural Ordinance
(10) When the Guest applies for accommodation, keeping dark about his/her intention to generate his/her own profit by reselling a booked room or act as an intermediary for fees in regard to the room.
(11) When demands are made by violent means, or handling of unreasonable burdens is demanded in regard to a stay
(12) When the Hotel considers it inappropriate to grant accommodation to the person seeking accommodation for reasons similar to those mentioned above.


Article 6
(Right to Cancel Accommodation Contracts by the Guest)

1.The Guest is entitled to cancel the Accommodation Contractby notifying the Hotel.
2. In the case when the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested the payment of the deposit during the specified period as prescribed in Paragraph 3 of Article 3 and the Guest has cancelled before the payment), the Guest shall pay cancellation. However, in thecase when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed of the obligation of the payment of the cancellation charges in case of cancellation by the Guest.
3. In the case Guest does not appear by 10:00 p.m. of the accommodation date without advance notice (1 hours after the expected time of arrival if
the Hotel is notified), the Hotel may regard the Accommodation Contract as being cancelled by the Guest.
The Guest shall not be entitled to make any assertions or claims regarding such decisions and actions taken by the Hotel.


Article 7
(Right to Cancel Accommodation Contracts by the Hotel)

1. The Hotel may cancel an Accommodation Contract and terms of use of hotel facilities under any of the following cases:
(1) When the Guest seeking accommodation is deemed likely to conduct or to have conducted himself/herself in a manner that will contravene laws, public order or good morals in regard to his/her accommodation
(2) When those wishing to stay are deemed to fall under any of the following (a)through (c);
(a) Criminal Gangs, Gang Members, associate members or affiliates of Criminal Gangs or other such antisocial groups
(b) When the business activities of a corporation or other organizations are controlled by a Criminal Gang or Gang Members
(c) A corporation whose executives include anyone determined to be a Gang Member
(3) When those wishing to stay have caused considerable trouble to other guests through their words or actions
(4) When the Guest seeking accommodation is clearly detected as carrying an infectious disease
(5) When demands are made by violent means, or handling of unreasonable burdens is demanded in regard to a stay;
(6) When the Hotel is unable to provide accommodation due to force majeure including natural calamities
(7) When falling under any of the cases stipulated in Prefectural Ordinances for Enforcement of the Hotel Business Act
(8) When the Guest does not observe prohibited actions (only for the purpose of fire prevention), such as smoking in bed, mischief to
fire-fighting facilities or other prohibitions under the Use Regulations stipulated by the Hotel
(9) When demands are made by violent means, or handling of unreasonable burdens is demanded in regard to a stay
(10) When the Hotel considers it inappropriate to continue the Accommodation Contract for any of the above reasons.
2. In the case when the Hotel has cancelled the Accommodation Contract in accordance with the preceding Paragraph, the Hotel shall not be entitled to charge the Guest for any services which he did not receive during the contractual period.


Article 8
(Registration of Accommodation)

The guest shall register the following particulars on the day of accommodation
(1) Name, age, sex, address of the Guest(s)
(2) For foreigners who do not have a domicile in Japan Guest(s), nationality, passport number
(3) Other particulars deemed necessary by the Hotel.


Article 9
(Occupancy Hours of Guest Rooms)

1.The Guest is entitled to occupy the contracted guest room of the Hotel from 3p.m. to 11 a.m. the next day. However in the case the guest room is contracted continuously, the Guest may occupy it all day long, except for the days of arrival and departure.
2.The Hotel may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the guest room beyond the time prescribed in the same Paragraph, In this case, an additional fee will be charged which the Hotel will determine at its discretion and present to the Guest.


Article 10
(Observance of Use Regulations)

The Guest shall observe the Use Regulations established by the Hotel, which are posted within the premises of the Hotel.


Article 11
(Business Hours)
1. The business hours of facilities, etc. of the Hotel shall be notified by brochures as provided, notices displayed in each place, service directories in guest rooms and others.
2. The business hours specified in the preceding Paragraph are subject to temporary changes due to unavoidable circumstances of the Hotel. In such cases, the Guest shall be informed by appropriate means.


Article 12
(Payment of Accommodation Charges)

1. The breakdown of Accommodation Charges, etc. that the Guest shall pay is as listed in the Attached Table No.1
2. Payment of the accommodation fees, etc. referred to in the preceding paragraph shall be made by credit card at the time of reservation or when invoiced by the Hotel.
3. Accommodation Charges shall still be paid even in the case when the Guest does not stay at the Hotel at his/her discretion after the Hotel has offered a guestroom and made it available for him/her to use.


Article 13
(Liabilities of the Hotel)

1. The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest in the course of fulfilling or nonfulfilling of an Accommodation Contract and/or related agreements. However, the same shall not apply in the case when such damage has been caused by reasons attributable to the Hotel.
2. The amount of the liability for damages that the Hotel shall bear under this Contract (irrespective of whether it is liability for breach of contract, tort or any other legal liability) shall be limited to the total amount of accommodation fees, etc. paid by the Guest to the Hotel at the time the damage occurred (excluding the amount equivalent to consumption tax).
3. The Hotel is covered by Hotel Liability Insurance in order to deal with unexpected fire and/or other disasters.


Article 14
(Handling When Unable to Provide Contracted Rooms)

1. The Hotel shall, when unable to provide contracted rooms, arrange accommodation of the same standard elsewhere for
the Guest insofar as practicable with the consent of the Guest However, if the guest does not wish to make such arrangements, This does not apply if you wish to explore other accommodation on your own.
2. In the event that the Hotel is unable to provide guest rooms due to natural disasters or other difficult circumstances, However, when the Hotel cannot provide accommodation due to causes for which the Hotel is not liable, the Hotel shall not compensate the Guest.


Article 15
(Handling of Deposit Articles)

The Hotel shall not be liable for any loss, breakage or other damage caused to items brought into the Hotel by the Guest.


Article 16
(Custody of Baggage and/or Belongings of the Guest)

1.If the Guest's baggage or belongings are left behind at the Hotel after check-out and are discovered by the Hotel, they will, in principle, be kept for a certain period of time determined by the Hotel, including the day they were found.
2.The liability of the Hotel regarding the custody of the Guest's baggage and belongings in the case of the preceding Paragraph shall be in accordance with the provisions of the preceding Article.


Article 17
(Liability of the Guest)

The Guest shall compensate the Hotel for the damage caused through intention or negligence on the part of the Guest.


Article 18
(Waiver for Computer Communication Service)

Please be informed that we are not responsible for any possible damage that may be caused by a system failure or for other reasons while the computer communication services are being used. In addition, the Guest may be required to compensate the Hotel and a third party for any possible damage caused by acts that we judge to be an inappropriate use of our computer communication system.


Article 19
(Changes to these Terms)

1. The hotel may change the terms and conditions of accommodation and terms of use at the discretion of the hotel in the following cases.
(1) When changes to the accommodation contracts, etc. fit the general interests of users.
(2) When changes to the accommodation contracts, etc. are not contrary to the purpose of the contract and are reasonable in light of the necessity for the change, the appropriateness of the content after the change, the details of the change and other changes.
2. When making any changes to these Terms and Conditions, the Hotel shall specify the date when the changes will come into effect and shall notify Guests of the changes, the new terms and conditions, and their date of effect via the Internet or other appropriate means.


Article 20
(Governing Laws and Agreed Court with Jurisdiction)

Any dispute relating to an Accommodation Contract between the Hotel and the Guest shall be governed by Japanese laws and shall be referred to the district court or the summary court having jurisdiction over the location of the head office of the company that manages and operates the Hotel

Note:

1. The percentages signify the rate of cancellation charge to the Basic Accommodation Charge.

Rules and Regulations

In order to assure the maximum comfort and safe of all guests, we ask for your cooperation in observing the following rules and regulations in accordance with the “General Conditions for Accommodations, Article 10”.
If a guest does not observe House Regulations, the Hotel may choose not to permit further use by the guest.
1. Please do not avoid using heating or cooking fires as well as irons, etc. in the hotel which are not furnished by the hotel.
2. This hotel is entirely non-smoking.
3. Meeting with guests from outside the hotel is not allowed.
4. The following organizations and individuals will be denied accommodation and use of our hotel facilities.
(a) Organized crime groups, members of organized crime groups, organizations related to organized crime groups and related parties
(b) A person affiliated with a corporation or other organization whose business activities are controlled by an organized crime group or a member of an organized crime group
(c) Antisocial groups, antisocial group members and related parties
(d) When assault, injury, intimidation, blackmail, violent demands, or demands for burdens that are beyond reasonable limits, or similar acts are recognized
(e) Those deemed to be causing significant inconvenience to other customers, such as drunk persons
(f) A person who fails to immediately stop a violation of the hotel rules after receiving a warning from the hotel
(1) If any of the above items (a) through (f) apply to you, we will refuse you any and all use of the service from that point onwards.
(2) We may refuse to accommodate guests who are carrying a contagious disease or other illness that may cause discomfort or inconvenience to other guests.
5. Please refrain from shouting and loud singing in the Hotel.
6. Please do not bring the following into the Hotel
(a) Pets and other animals in general
(b) Malodorous articles
(c) Excessively large quantity of personal goods
(d) Explosive, volatile or flammable materials
(e) Unlicensed firearms or swords
7. Please refrain from engaging in gambling, behaving in an indecorous manner or committing acts likely to cause annoyance to other guests of the Hotel.
8. Please refrain from inviting outsiders into your room or allowing them to use the facilities and items in your room.
9. The furnishings or equipment inside your room may not be moved to other locations in the building or taken out of the Hotel without permission.
10. Please refrain from attaching any foreign objects to the hotel buildings or facilities or modifying them in any way that alters their current state.
